1. Acceptance of Terms

By accessing or using TollFighter ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

TollFighter provides automated toll violation dispute assistance. We analyze your violation, generate dispute letters, and facilitate submission to toll authorities. We are not a law firm and do not provide legal advice. Use of our Service does not create an attorney-client relationship.

3. Fees and Billing

Success fee: You owe TollFighter 30% of the amount actually saved (i.e., waived or reduced by the toll authority) as a result of our dispute filing. This fee is only charged when your dispute is successful. If the dispute is denied, you owe nothing.

Fighter+Monitor subscription: The optional monitoring plan is billed at $4.99/month. You may cancel at any time through the customer portal. No refunds are issued for partial billing periods.

Physical mail fee: A fee of approximately $1.50 applies when your dispute letter is sent via USPS certified mail through our Lob integration. This fee covers postage and handling.

4. Accuracy of Information

You represent that all information you provide — including violation details, evidence, and personal information — is accurate and complete. Providing false or misleading information may result in termination of your account and potential legal liability.

5. No Guarantee of Outcome

TollFighter does not guarantee that any dispute will be successful. Success rates vary by authority, ground, and individual circumstances. Our estimated success rates are based on historical data and are not promises of future results.

6. User Responsibilities

You are responsible for responding to any follow-up requests from toll authorities, maintaining accurate contact information, and reporting dispute outcomes to TollFighter through our platform so that success fees can be collected.

7. Intellectual Property

All content, software, and materials provided by TollFighter are the exclusive property of TollFighter and are protected by applicable copyright and intellectual property laws. You may not reproduce or redistribute any portion of the Service without written permission.

8. Limitation of Liability

TollFighter's total liability to you for any claim arising out of these Terms or the Service shall not exceed the fees you have paid to TollFighter in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, punitive, or consequential damages.

9. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Massachusetts.

10. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. Material changes will be communicated via email.
